Step 1: Contact a reputable lawyer

  • Once you’ve found the perfect property, the first step is to contact a reputable lawyer who specializes in real estate matters in Marbella and the surrounding Costa del Sol region.
  • The lawyer will help you obtain the Nota Simple, a document that outlines any outstanding debts associated with the property you’re interested in.
  • Your lawyer will ensure that the information in the Nota Simple matches the property’s characteristics before proceeding to the next step.

Step 2: Sign a pre-purchasing agreement

  • Assuming that everything checks out with the Nota Simple, you’ll move on to the signing of a pre-purchasing agreement, which grants you the right of reservation for the property.
  • You’ll typically be required to pay a deposit of 10% of the total amount (although this percentage may vary in certain circumstances).
  • It’s important to note that if you decide to back out of the deal, you’ll forfeit your deposit, whereas if the seller decides to cancel, they’ll be required to return your deposit in double the amount.

Step 3: Secure financing

  • Simultaneously with the signing of the pre-purchasing agreement, you’ll need to secure financing for the property.
  • The bank will conduct an individual valuation of the property based on the agreement, and the acquired loan will be based on that amount rather than the original selling price.
  • This process typically incurs a fee of €300 to €500, depending on the bank and other external factors.

Step 4: Transfer of ownership

  • The final step is the transfer of ownership, which will be certified by a notary.
  • Both parties will sign the agreement, and the process will be concluded.

Step 5: Additional considerations

  • Consider taxes on existing properties, which increase according to the property’s value, with a maximum tax rate of 10% for properties valued over €700,000.
  • Consider obtaining an NIE, a unique identification card required for anyone who wasn’t born in Spain. Register the property at the Property Registry.
  • Ensure that all necessary documents are in order before making a purchase, including a construction permit, first occupancy license, and property registration certificate.
  • Ask developers for a certificate from the Commercial Registry and details of any claims or lawsuits that might affect the property.
